Carlisle Son Denies Gross Negligence Manslaughter Over Elderly Mother's Death as Trial Begins
A Carlisle man has denied a charge of gross negligence manslaughter over the death of his elderly mother. The trial has begun at Carlisle Crown Court. Jurors heard the prosecution outline allegations surrounding the final weeks of the 72 year old woman's life.
Stewart Irwin, 56, is accused over the death of his mother, Veronica Irwin, at their Carlisle home in July 2023. Prosecutors allege he was her main carer and failed to provide the care and assistance she needed. Irwin denies the charge and the case is now being considered by a jury.
The prosecution told the court that paramedics found Veronica Irwin in what was described as a perilous condition after her son contacted emergency services. It is alleged she had remained on a bathroom floor for around two weeks following a fall. Prosecutors argued that she suffered a painful and inhumane death while under the care of her son.
Jurors were told the defendant claimed his mother had refused to get up after falling and that he had acted as her primary carer. The prosecution contends that reasonable steps were not taken to protect her welfare or obtain appropriate medical assistance. The defence disputes the allegation of gross negligence manslaughter and Irwin has entered a plea of not guilty.
The trial is expected to hear further evidence from witnesses, including medical professionals and emergency responders. A jury will ultimately decide whether the prosecution has proved the charge beyond reasonable doubt. The proceedings at Carlisle Crown Court are continuing.
Gross negligence manslaughter cases require prosecutors to prove that a defendant owed a duty of care, seriously breached that duty and that the breach substantially caused the victim's death. The court will continue to hear evidence before closing submissions and judicial directions are given to the jury. No verdict has yet been reached.
